Privacy Policy

This Privacy Policy explains how The 1912 Society LLC(“1912 Society,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you use our websites, mobile and iOS applications, community boards and chat, the “Louie” AI assistant, news and pick’em features, games, merchandise shop, and paid memberships (together, the “Service”). It works together with our Terms of Service. By using the Service, you agree to this Policy.

1. Information we collect

  • Account information — username, display name, email address, and authentication details (for example, an email sign-in link or a sign-in provider identifier). We do not store your account password in plain text.
  • Profile & community information — avatar, bio, preferences, and settings you choose to provide.
  • User content — posts, comments, chat messages, reactions, pick’em and prediction entries, trivia and game activity, prompts you send to Louie, and support messages.
  • Membership & transaction information — your Membership tier and status, order history, and (for merchandise) shipping details. Payment card details are collected and processed by our payment processor; we do not receive or store your full payment card number — typically only your subscription status and limited details such as the card’s last four digits and expiration.
  • 1912 Coins & activity data — coins earned, badges, streaks, standings, and related non-monetary status data.
  • Usage & device information — IP address, device and browser type, operating system, app version, identifiers, pages and features used, referring pages, and timestamps.
  • Cookies & similar technologies — described in Section 6.
  • Push tokens — if you enable notifications, a device push token so we can deliver them.
  • Communications — emails and messages you send us and your notification and marketing preferences.

2. Sources of information

We collect information: (a) directly from you when you register, subscribe, post, or contact us; (b) automatically as you use the Service (usage, device, cookies); and (c) from third parties such as our authentication provider, payment processor, and sports-data providers.

3. How we use information

  • Create and manage your Account and display your activity, coins, and standings;
  • Provide, operate, maintain, and secure the Service, including Louie and community features;
  • Process Memberships, orders, and payments, and keep your access current;
  • Deliver notifications and communications you request and, where permitted, marketing you have opted into;
  • Personalize content and features;
  • Detect, prevent, and respond to fraud, abuse, spam, and security incidents, and enforce our Terms and Community Guidelines;
  • Analyze usage to understand and improve the Service (in aggregate or de-identified form where feasible);
  • Comply with legal obligations and enforce our rights.

4. Legal bases (where applicable)

Where required by law (for example, in the EEA/UK), we rely on: performance of our contract with you (to provide the Service); our legitimate interests (to secure, analyze, and improve the Service and prevent abuse); your consent (for marketing and optional cookies, which you may withdraw); and compliance with legal obligations.

5. How we share information

We do not sell your personal information, and we do not “share” it for cross-context behavioral advertising as those terms are defined under U.S. state privacy laws. We disclose personal information only as described here, to service providers/processors bound by contract to use it only on our behalf:

  • Authentication — our sign-in provider, to verify your identity and secure your Account.
  • Hosting & infrastructure — our cloud hosting provider (Railway), to run the Service and store data.
  • Payments — Stripe, to process Memberships and orders (Stripe handles your card data under its own privacy policy).
  • Email — our email provider (Resend), to send transactional and opted-in messages.
  • Analytics — our product-analytics provider (PostHog), to measure and improve usage.
  • AI — our AI provider (Anthropic), to power the Louie assistant using the prompts you submit.
  • Push notifications — the push-delivery service(s) used to send alerts to your device.
  • Sports data — sports-data providers that supply scores, schedules, and related content.

We may also disclose information: to comply with law, legal process, or lawful government requests; to enforce our agreements and protect the rights, safety, and property of The 1912 Society, our users, or the public; and in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

6. Cookies & tracking

We and our providers use cookies, local storage, SDKs, and similar technologies to keep you signed in, remember preferences, secure the Service, and measure usage. You can control cookies through your browser or device settings; blocking some cookies may affect functionality. Where required, we obtain consent for non-essential cookies. We do not use cookies for third-party targeted advertising.

7. Retention

We keep personal information only as long as needed for the purposes described here, then delete or de-identify it. General guidance by category:

  • Account & profile — for the life of your Account, then deleted or de-identified within a reasonable period after closure.
  • User content — until you or we delete it; some content shared with others may persist in their view or in backups for a limited period.
  • Transaction & billing records — as required for tax, accounting, and legal purposes (commonly several years).
  • Usage & device logs — for a limited period for security and analytics, then aggregated or deleted.
  • Support communications — for a reasonable period to service your requests.

8. Security

We use administrative, technical, and organizational safeguards designed to protect personal information — including encryption in transit, access controls, and use of reputable processors. No system is perfectly secure, and we cannot guarantee absolute security. Keep your credentials confidential and notify us of any suspected compromise.

9. Children’s privacy

The Service is intended for people 13 and older and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it. If you believe a child under 13 has provided us information, contact us at the1912society@gmail.com.

10. Your California privacy rights (CCPA/CPRA)

If you are a California resident, you have the right to: know and access the categories and specific pieces of personal information we collect, use, and disclose; delete personal information; correct inaccurate personal information; opt out of the “sale” or “sharing” of personal information; and not be discriminated or retaliated against for exercising your rights. We do not sell or share personal information as those terms are defined by the CPRA, and we do not knowingly sell or share the personal information of consumers under 16. You may use an authorized agent to submit requests, and California’s “Shine the Light” law lets you request information about disclosures to third parties for their direct marketing (we do not make such disclosures). To exercise these rights, see Section 13; we will verify your request before responding.

11. Other U.S. state privacy rights

If you reside in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, or another state with a comprehensive privacy law, you may have the right to confirm whether we process your personal data; access, correct, or delete it; obtain a portable copy; and opt out of targeted advertising, sale of personal data, and certain profiling. We do not sell personal data or engage in targeted advertising as those laws define them. Where a state provides an appeal process for a declined request, we will honor it. To exercise these rights, see Section 13.

12. International users & data transfers

We operate in the United States, and the Service is directed to U.S. users. If you access it from outside the U.S., your information will be transferred to and processed in the U.S., where privacy laws may differ from those in your location. If you are in the EEA, UK, or a similar jurisdiction, you may have rights to access, correct, delete, restrict, or object to processing, to data portability, and to withdraw consent, and to lodge a complaint with your supervisory authority. Where we transfer data internationally, we use appropriate safeguards as required by law.

13. How to exercise your rights

You can access and update most account details in your profile settings, turn off push notifications, and opt out of non-essential emails at any time via the unsubscribe link or your settings. We will verify your identity and respond within the timeframes required by law. We will not discriminate against you for exercising your rights. You may use an authorized agent where the law permits.

14. Data breach

If we experience a data breach affecting your personal information, we will notify affected users and applicable regulators as required by law, without undue delay.

15. Third-party services

The Service links to and integrates third-party services (such as payment processors, authentication, app stores, and sports-data providers). Their handling of your information is governed by their own privacy policies, which we do not control.

16. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Policy with a new effective date or notifying you in the app or by email). Your continued use of the Service after changes take effect constitutes acceptance.
